What you're describing is really a small-scale variant of the "domain 
tasting" that's been going on for some time.  People find that domain 
names they've searched using registration tools consistently change 
from available to registered...sometimes by a 3rd party who just 
happens to hold hundreds of thousands of domains (until the grace 
period expires) and sometimes by the registrar themselves.

I understand that ICANN has a payment proposal to fix the problem 
starting in July, but I haven't looked at that in detail.
