DD-WRT is using closed-source wl driver (they have access to
the source, so can compile it against any kernel).
I understand that because BrainSlayer has signed NDAs, he can
support Broadcom chipsets better than OpenWRT.
OpenWRT's (human) organization is much more to my liking so I try to
avoid Broadcom chips.
It strikes me that <http://en.wikipedia.org/wiki/DD-WRT> seems
santized. <http://en.wikipedia.org/wiki/Talk:DD-WRT> is worth a look.
It includes the phrase "GPL terrorism".
