It's not quite that clear-cut. UBS appear to have been providing
tax-evasion services by setting up undeclared Swiss bank accounts for
clients. Tax evasion is a crime, so it's a criminal investigation from
several countries. Here's something from yesterday on France's
investigation into UBS:

The former French budget minister Jerome Cahuzac resigned over
allegations he had an undeclared Swiss bank account. This isn't “Yay
Freedom!”, more “Only the little people pay taxes”.
