Maybe the PS3 tries to negotiate HDCP, but is willing to do gameplay
even if HDCP isn't available.  For blueray playback it should refuse
without HDCP, but for gameplay it doens't have to.  That's my guess.

I still doubt it is a solution in general.  Just PS3 specific I think.
