YouTube stopping unlicenced TV access

Apparently there are two interfaces to YouTube: flash and "API".
Apparently Terms Of Service forbid unlicensed devices from using the
API. Now they (YouTube/Google) are enforcing this restriction so, for
example, Popcorn Hour can no longer use it.
WDTV uses the same API. I don't know if they are licensed.
