Getting the code and it being Open Source are related but not
equivalent.  Read the CDDL.  It says that they own the code, you may
modify it, and they own the modifications.  It is a "what's mine is
mine, what's yours is also mine" license.  Contrast that with the GPL,
GPL2, LGPL or BSD licenses.
