3. You're making a statement of fact on something you simply have no way of
knowing.  "They have a valid case" are your exact words, I'm not misconstruing
anything.  Can that be taken as anything but a statement of fact?  I don't
think so.
4. You're entitled to your opinion, but if you want to express it in a public
forum then you ought to make it clear that it's *your* opinion and the readers
will decide how relevant it is, which in this particular case really isn't, as
we have already established you're not judge in a US Court of Law with
jurisdiction over this case.
